Cazoo prize draw terms and conditions
1. The promoter and the partner
The promoters are:
a) The Jockey Club (“TJC”) of 75 High Holborn, London, WC1V 6LS; and
b) Cazoo Limited (“Cazoo”) of 41 Chalton Street, London, NW1 1JD.
2. The prize draw
2.1 The title of the Prize Draw is the “Ultimate Cazoo Derby Experience”
competition (the “Prize Draw”).
2.2 The Prize Draw is free to enter and winners are selected at random by Cazoo from valid entries received by TJC in accordance with these terms and conditions.
3. How to enter
3.1 The Prize Draw will run from 00:00 (BST) on 18 May 2022 (the “Opening Time”) to 23:59 (BST) on 25 May 2022 (the “Closing Time”) inclusive.
3.2 All entries must be received by TJC by no later than the Closing Time. All entries received after the Closing Time are invalid.
3.3 To enter the Prize Draw, you must complete the competition registration form and submit your contact details with your name and your email address.
3.4 No purchase is necessary.
3.5 TJC and Cazoo do not accept responsibility for entries that are lost, mislaid, damaged, or delayed, regardless of cause, including (for example) as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.6 By entering the Prize Draw, you agree to be bound by these terms and conditions.
4. Eligibility
4.1 The Prize Draw is only open to UK residents aged 18 years or over, except for:
(a) employees, contractors and workers of Cazoo or its group companies;
(b) employees of TJC;
(c) employees of any affiliates, subsidiaries, commercial partners, advertising or promotion agencies of Cazoo;
(d) anybody who is professionally connected with the Prize Draw or its administration; or
(e) members of the immediate families (defined as parents, children, siblings, spouses, and life partners) or households of anyone in 4.1(a), (b), c) and (d) above,
who may not enter the Prize Draw.
4.2 By entering the Prize Draw, you confirm that you are eligible to do so and to claim any Prize that you win. TJC may require you to prove that you are eligible to enter the Prize Draw, for example by providing ID.
4.3 TJC will not accept entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with; or
(d) incomplete.
4.4 There is a limit of one entry to the Prize Draw per person. Entries on behalf of another person and joint entries are not allowed.
4.5 TJC or Cazoo may disqualify you if it reasonably believes that your conduct is in breach of these terms and conditions, fraudulent or otherwise contrary to the spirit or intention of the Prize Draw.
5. The prizes
5.1 The prizes are:
5.1.1 One individual will win the opportunity for them plus a guest to:
a) watch ITV record the Opening Show and meet the presenting team on Cazoo Derby Day which will take place on Saturday 4th June 2022;
b) hospitality package for two at the Winning Post Restaurant;
c) visit the Parade Ring before the first race on Cazoo Derby day on Saturday 4th June 2022;
d) judge the best turned out horse before the first race on Cazoo Derby Day on Saturday 4th June 2022 and present the trophy to the winning connections; and
e) to enjoy a glass of champagne in the winning connections room after the race.
(Together a “Prize”)
5.2 The Prize winner and their guest attending the Cazoo Derby Day to enjoy their Prize must also comply with all policies, rules and reasonable instructions provided by TJC, Cazoo, venue operators and/or any authority at the venue. TJC, the relevant venue operators and authorities reserve the right to remove any prize winner (and/or their permitted guest) for failing to comply with the policies, rules or instructions or otherwise behaving in an inappropriate manner.
5.3 TJC and Cazoo reserve the right to replace all or part of any Prize with an alternative if the original is not available.
5.4 Prizes are not transferable, exchangeable or negotiable. There is no cash alternative to any Prize.
5.5 To claim the Prize, the winner must respond to Cazoo’s email and provide all requested information within 48 hours after the message is sent.
6. Winners
6.1 Cazoo’s decision is final and no correspondence or discussion will be entered into.
6.2 Cazoo will contact the winner as soon as reasonably practicable after the Closing Time by email.
6.3 Cazoo must make available information that indicates that a valid Prize award took place. To comply with this obligation, Cazoo will send the surname and county of Prize winners (and copies of any winning entries, if applicable) to anyone who emails events@cazoo.co.uk within one month after the Closing Time. If you object to your surname, county or winning entry being made available, please contact Cazoo at events@cazoo.co.uk. If you do this, Cazoo must still provide the information to the Advertising Standards Authority on request.
7. Claiming the prize
7.1 If you win a Prize, you will have 48 hours after Cazoo sends you an email to claim your Prize as described in paragraph 5.5 above. If you do not claim the Prize by this date, your claim will become invalid.
7.2 The Prize may not be claimed by someone else on your behalf.
7.3 Cazoo will make reasonable efforts to contact the winner by the email submitted on the competition registration form. If the winner has not responded and provided all of the requested information within 48 hours after Cazoo’s email is sent, Cazoo may offer the Prize to the next eligible entrant selected from the valid entries that were received before the Closing Time.
7.4 TJC and Cazoo do not accept any responsibility if you are not able to take up the Prize.
7.5 Winners may be asked to provide identification and proof of address proving their eligibility before they are entitled to receive any Prize. Winners may be required to participate in further publicity or advertising in connection with winning the Prize
8. Limitation of liability
8.1 As far as permitted by law, TJC or Cazoo, their agents and distributors
are not in any circumstances liable to compensate the winner or accept any
liability for any loss, damage, personal injury or death occurring as a result of
taking up the Prize, except where this is caused by the negligence of TJC or
Cazoo, its agents or distributors or that of its employees. Your statutory rights
are not affected.
9. Ownership of entries and intellectual property rights
9.1 TJC and Cazoo do not claim any rights of ownership in your competition entry.
9.2 You agree that TJC and Cazoo may, but are not required to, make your entry available on their websites and any other media, whether now known or invented in the future, and in connection with any publicity of the Prize Draw. You grant TJC and Cazoo a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in your entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the entry and any accompanying materials for those purposes. You also agree to waive all moral rights in and to your entry to which you may now or at any time in the future be entitled anywhere in the world.
10. Data protection and publicity
10.1 TJC and Cazoo will only process your personal information as set out in their Privacy Policies (https://www.cazoo.co.uk/privacy-policy and (https://www.thejockeyclub.co.uk/privacy), to administer the competition and to announce winners as described in paragraph 6.3 above. TJC will share your personal information with Cazoo for the purposes of administering the competition and selecting the Prize winner.
10.2 You agree to participate in a reasonable amount of publicity on TJC or Cazoo’s behalf if asked to do so by TJC or Cazoo. This might include publishing your name and photograph in any media.
11. General
11.1 If TJC or Cazoo believes that you have breached these terms and conditions, TJC or Cazoo may (at their discretion) exclude you from participating in the Prize Draw.
11.2 TJC or Cazoo may void, suspend, cancel or amend the Prize Draw if it becomes necessary to do so.
11.3 Prizes do not include any reimbursement of any travel, accommodation expenses or food and drink costs.
11.4 TJC and Cazoo cannot guarantee the performance of any third party, including the other, and shall not be liable for any act or default by a third party.
11.5 These terms and conditions are governed by English law. All entrants to the Prize Draw submit to the exclusive jurisdiction of the courts of England and Wales, except that if you are resident in Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident in Scotland, you may also bring proceedings in Scotland.
